Joseph sues Matthew for violating trust's no contest clause

In the court case of Joseph Kaisersatt vs Matthew A. Guerra, filed in the First Appellate District Division Two of the Court of Appeal of the State of California, with case ID A166640 on April 24, 2024, a dispute arose over the Theodore P. Glaza Trust. Both Kaisersatt and Guerra are beneficiaries of this trust created by Theodore P. Glaza.

Kaisersatt petitioned to enforce the trust's no contest clause under Probate Code section 17200, subdivision (b), in response to a petition filed by Guerra to enforce a beneficiary designation to Glaza's IRA account. The trial court found that Kaisersatt had not met his burden of proving his claims had minimal merit.

The court ruled that the beneficiary designation did not fall within the category of documents subject to the no contest clause. However, even if it did, Guerra had probable cause to petition to enforce it.

Kaisersatt is seeking for judgment and damages based on his claim that Guerra violated the trust's no contest clause by attempting to enforce a beneficiary designation on Glaza's IRA account.
