Peter Nelson sues Paul S. Mula for nuisance related to a barking dog and an unpermitted dwelling unit

In the Superior Court of California, County of Santa Clara, plaintiff Peter Nelson, represented by attorney Seth W. Wiener, has filed a lawsuit against defendants Paul S. Mula, Patricia M. Bye, individually and as Trustee of The Helene Mula-Stouky Trust Dated November 24, 1997, and Does 1 to 10 (collectively referred to as "Defendants"). The case ID is 24CV436375 and it was filed on April 22, 2024. The lawsuit pertains to a nuisance claim related to the defendants' residential property located at 735 Arbor Drive, San Jose.

The plaintiff alleges that the defendants have permitted a nuisance at their property by having a barking dog and an unpermitted alternative dwelling unit. According to the complaint, this situation has caused Nelson significant stress and sleepless nights over several years.

Nelson also claims that his attempts to negotiate with Mula about the dog's incessant barking have been consistently rebuffed. He alleges that the noise from the dog is so disruptive that he has had to resort to using noise-cancelling headphones and earplugs in order to get any rest.

In his lawsuit, Nelson seeks damages for his suffering and an order requiring an abatement of the nuisance conditions at the defendants' property.
